Wills, Estate and Trust Law

Preparing you for Life’s Unexpected Surprises/Solution Driven Estate Litigation
Estate Litigation is a specialized area of litigation that requires up-to-date knowledge of the most current laws and regulations. This is combined with the need to handle such matters with sensitivity as estate litigation areas are fraught with the emotions of the parties involved.

Estate Litigation Expertise
The Law Firm of Robert Doran has been skillfully helping out Trustees, Beneficiaries, Executors and Administrators prosecute or defend litigation claims on Trust and Administration of Estates. For past 30 years we have been successfully litigating Estate and Trust related matters:

Contested Wills – A will to be valid must be expressed out of the free consent of the testator and comply with all the statutory executor requirements. Some of the grounds on which a will can be challenged or contested are:
  • Lack of Testamentary Capacity of the Testator;
  • Lack of consent of the Testator in the execution of the will;
  • Undue Influence exercised on the Testator;
  • Non-compliance with the statutory requirements for the valid execution of the will;
  • Exercise of fraud or forgery in the execution of the will;

Will Interpretations – Sometimes it becomes difficult to interpret the real intentions of the Testator as expressed in the will either due to poor or negligent drafting or some material change in the circumstances. While interpreting the will regard must be given to the true intentions of the Testator as may be read from the will and from the circumstances surrounding the Testator’s life.

Passing of Accounts –It is the responsibility of the Trust Executor, Trustees, Estate Planner, Guardians/Attorneys for property of the mentally disabled persons to maintain the financial records of the property they are overseeing. The accounts thus maintained have to be presented to the beneficiaries and there are chances of objections being raised to the way accounts of the estate are maintained. Some of the grounds for calling into question the Accounting of the Estate are:

  • Trustee compensation disputes
  • Disbursement of funds from the Estate
  • Investments made from Trust income
  • Estate Settlements
  • Unjust Enrichment

Trustee Disputes- involve challenges to the way the Trust is administered by the Trustee/Executor or Estate Planner; Variations of Trusts; Trustee/Executor working under a beneficiary’s undue influence; Fiduciary Litigation; Trustee/Executor removal disputes
